Compliance requirements
The tender documents list the standard exclusion grounds, mainly criminal convictions such as participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking, and other grounds under the Public Procurement Act. The bidder must confirm whether any exclusion ground applies and, where allowed, may provide evidence of self-cleaning. The machine-readable notice did not include the full set of precise exclusion details, so they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have experience: within the 60 months preceding the start of the procurement, the bidder itself or the joint bidders as a whole must have properly performed at least one road construction contract for roads open to public use, including gravel surface repair works in a total amount of at least 45,000 m². The contracting authority may request a confirmation from the client regarding the volume, deadline and proper performance of the works; it is recommended to submit this together with the tender. If the bidder relies on the resources of another company, it must also submit a tenderer profile for that company and that company’s consent allowing the bidder to rely on its capabilities and confirming that it will take part in the direct performance of the contract to the extent relied upon. The project manager must have the legal right to manage road construction works under the law of the country of residence; if the project manager does not reside in Estonia and does not hold at least a road engineer level 6 professional certificate in the road construction and maintenance specialisation, a copy of the operating licence from the country of residence or other proof of that right must be submitted. The tender must comply with the tender documents, be unconditional, and include Form 3, the tender price in euros, and confirmation of equivalence where equivalent solutions are used.
