Compliance requirements
The tender documents include the standard exclusion grounds from the Estonian Public Procurement Act, especially convictions for participation in a criminal organisation, corruption, fraud and other mandatory exclusion grounds. The bidder must confirm whether any such ground applies to the company or to persons who manage or represent it. If an exclusion ground exists, the bidder may need to provide evidence of self-cleaning, where allowed by law or by the tender documents. The machine-readable notice did not include the full list in a concise form, so the exact exclusion grounds must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 100,000. If the bidder relies on the capacities of another company, the bidder must also provide that company’s details and, if required, prove that the resources are available and will be used for contract performance.
During the 36 months preceding the start of the procurement, the bidder must have completed at least two contracts for call centre services. Each contract must have had a value of at least EUR 50,000 excluding VAT. The bidder must provide the contract value, dates and the details of the other contracting party; if the contract was a public procurement, the reference number must also be stated.
The bid must include Annex 2 to the tender documents, with the required descriptions and the bid price form completed. The bidder must confirm that the bid complies with the tender documents, that no conditional bid is submitted, that the bidder has the intellectual property rights needed to perform the contract, and that the bidder has reviewed the standard terms.
The bidder must be the official reseller of the offered service and must be able to expand and manage the system. The platform for the offered solution, as well as call recordings and emails until they are processed, must be located in the European Union in the bidder’s data centre or server room and must comply with ISO 27001 or an equivalent information security standard. The bid must include the relevant certificates.
If requested, the bidder must be ready to demonstrate the system at a location designated by the contracting authority in Tallinn no later than two weeks after the opening of bids. An Estonian user manual must also be provided, describing the functionality for all users, the work processes and examples with screenshots.
Only subcontractors and suppliers whose place of residence or establishment is in Estonia, another EU Member State, an EEA Agreement country or a WTO Government Procurement Agreement country may be involved in contract performance.
