Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1) of the Public Procurement Act apply to it or to any entity whose resources it relies on. The bidder must also confirm that no exclusion ground under Section 95(4)(8) applies due to previous contract breaches, and that no exclusion ground under Section 95(4)(9) applies due to false information or failure to provide information about compliance with qualification requirements. If any of these grounds exist, the bidder must describe them in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have obtained the operating licence required under Section 12 of the Security Activities Act, or an exemption from it; reliance on another company’s licence is not allowed. The net turnover for each of the last three completed financial years must have been at least EUR 980,000 per year; assuming a calendar financial year, these are 2023, 2024 and 2025. The bidder must submit Form 1 showing these turnovers.
During the 36 months before the publication date of the contract notice, the bidder must have performed manned and technical security service contracts under which manned security services were provided at least on one site and technical security services on at least two sites, for at least 12 consecutive months. Form 1 must include a list of the contracts with the partners’ names, contact details, site address, contract duration and, where applicable, the public procurement reference number.
For performance of the security services, the bidder must involve a project manager who holds the professional certificate Security Manager, level 5, or an equivalent qualification, and who has at least 3 years of professional experience in managing manned and technical security services during the last 5 years. The project manager’s experience must be evidenced by a digitally signed CV; if needed, a client confirmation, contract or client-signed contract document must also be provided. If the certificate was issued outside Estonia, the bidder must also provide a document from the competent authority and a confirmation from the competent Estonian authority that the foreign qualification corresponds to the required qualification.
The bidder must have a quality management system implemented in the security activities field that meets at least ISO 9001 or an equivalent requirement. If certificate data are not available in the database, a copy of the certificate or a confirmation from an independent audit firm or accredited certification body must be provided. In addition, Form 1, Form 4, Form 5, the foreign qualification evidence if applicable, and Form 6 must be submitted by the bidder.
