Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no relevant convictions of the bidder or its managers/representatives for participation in a criminal organisation, breach of integrity, corruption, fraud, terrorist offences, money laundering or terrorist financing; no convictions for illegal employment of foreigners or breach of foreign workers’ conditions, including paying less than the statutory wage; no convictions for illegal use of child labour or human trafficking; and no tax, duty, environmental charge, social security or similar debt in the bidder’s home country. The bidder must also confirm that none of the voluntary exclusion grounds apply: no serious or persistent breach of a previous public contract leading to termination, price reduction, damages or penalties, and no false information or failure to provide required qualification data or additional documents. The notice also requires confirmation that the bidder is not established in the Russian Federation or the Republic of Belarus, and that materials, equipment and goods used in the works, including components, are not produced in or originating from Russia or Belarus; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 1,000,000. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years. At least six months must have passed since the end of the last completed financial year by the time the tender is submitted. As evidence, an extract from the reports for the last three completed financial years must be provided, unless the data are publicly available to the contracting authority.
The bidder must have completed, within the 60 months preceding the publication of the contract notice, at least three electrical construction contracts for a network operator within the meaning of the Electricity Market Act, at least one of which must have had a value of at least EUR 500,000 excluding VAT. Form 7 must be submitted together with a list of the contracts showing the value, signing dates and the other contracting parties, and, where necessary, a written confirmation from the other contracting party that the contracts were performed properly.
The tender must be submitted on the forms required in the procurement documents. These include the price quotation table and technical forms 2, 3, 4, 5 and 6. For Form 5, a reference list must also be provided: within the last three years, the factory must have produced at least 50 km of cable at the same or a higher voltage level with XLPE insulation, and the list must state the manufacturer’s name, cable type designation, rated voltages, Um, year of manufacture and customer name. For Form 6, the bidder must provide the name of the person who will install the 110 kV joints during contract performance, the manufacturer’s written confirmation or certificate if the installer is not the manufacturer, and a reference list of at least 64/110 kV joint terminations or joints installed during the last year.
The bidder must have a person in charge of electrical works with valid A-competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who has the relevant proof at the time of submission and has been added to Elektrilevi’s partner portal before the opening of tenders. The bidder must also have a person designated as responsible for the work operation, who must likewise be entered in the partner portal before the opening of tenders. If the bid is a joint tender, an authorised representative must be named and a power of attorney from the joint bidders must be included. The tender may not be conditional. If the right of representation does not arise from the articles of association, a power of attorney must be included in the tender documents.
The machine-readable notice did not include precise requirements for the business secret statement; these must be checked in the official tender documents.
