Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds under § 95(1) of the Public Procurement Act apply. In plain terms, the bidder must not have convictions related to participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; unlawful employment of foreign nationals or paying below the statutory wage; child labour or human trafficking; tax, environmental charge or social security arrears; or any situation where the contract would breach an international or Government sanction. Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three financial years must be at least EUR 140,000, and the bidder must provide the turnover data. Within the 36 months before publication of the tender notice, the bidder must have performed at least one contract similar to the subject of the framework agreement in the field of technical guarding services; the contract may still be ongoing if it otherwise meets the requirements. For the reference, the bidder must provide the contract title, description, public procurement reference number if available, start and end dates, contract value, and the client’s and contact person’s name, email address and telephone number. As compliance requirements, the bidder must also submit Form 2, the price table, and where applicable a joint bidders’ power of attorney, a trade secret explanation, an equivalence statement and details of personal data sub-processors.
