Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds under Section 95(1) of the Public Procurement Act apply to it. These include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal employment of foreigners, child labour or human trafficking, tax or social security debt, and situations where the contract would breach international sanctions. The bidder must also confirm that none of the optional exclusion grounds apply, such as serious or repeated breach of earlier public contracts or false statements about qualification requirements.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 500,000. An extract from the reports for the last three completed financial years, or other proof showing the turnover, must be submitted; for a legal entity registered in Estonia this may not apply if the data are publicly available to the contracting authority from a register. At least six months must have passed since the end of the last completed financial year by the bid submission date.
During the 60 months before the publication of the contract notice, the bidder must have performed at least three electrical construction contracts for a network operator within the meaning of the Electricity Market Act, and the total value of those reference contracts must be at least EUR 500,000 excluding VAT. Form 3 must be submitted together with a list of the contracts, their values, signing dates, details of the other contracting party and, where available, the public procurement register reference numbers; a written confirmation from the other contracting party that the contracts were performed properly must also be provided where required.
During the 36 months before the publication of the contract notice, the bidder must have prepared and handed over at least 10 compliant external electrical network construction projects to a network operator within the meaning of the Electricity Market Act. A compliant project is one completed on time and for which no contractual penalties or damages were paid. Form 4 must be submitted together with the list of projects, short descriptions, handover dates, details of the other contracting party and, where available, public procurement register reference numbers.
Form 5 with the list of workers must also be submitted in line with the minimum requirements in Annex 1. The required workers must have valid authorisations for live low-voltage work, including adding and removing series switch devices in insulated and non-insulated low-voltage switchboards, connecting the feeder line of a concentrator in a substation, connecting and disconnecting a branch connection on a low-voltage overhead line with bundled conductor cable, and replacing a pole on such a line. If valid certificates were not added to the partner portal when the bid was submitted, copies must be provided.
The bidder must have at least one person with a valid A-level electrical competence certificate or an equivalent professional qualification as an electrical engineer. If the bidder is not established in Estonia, it must provide confirmation and documents proving that the person declared in Form 5 has the required competence or equivalent professional qualification.
The bidder must also confirm that the required equipment and staff will be available for the full duration of the contract and that any replacements will be at least equivalent in terms of equipment, staff, references and qualifications. It must confirm that the Estonian language skills of B-persons, C-persons and switch operators involved in contract performance are at least level B1, that workers performing work at height have valid authorisations, that the contracting authority’s required forms, databases and environments will be used, and that only materials and equipment meeting the contracting authority’s requirements will be purchased and used. Subcontractors may be used only if they have no mandatory exclusion grounds; if optional exclusion grounds apply, the contracting authority’s prior written consent is required.
