Compliance requirements
The bidder may be excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or otherwise in a similar situation under the law of its country of establishment. The bidder may also be excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred, paid, or is being paid/deferred within 10 calendar days after notice. The notice also requires confirmation that the bidder has no exclusion grounds under the Public Procurement Act provisions referred to in the tender documents, that the average salary of its employees was not below 70% of the average salary in the relevant sector during the reference period, and that the bidder is not a related person to the technical consultant advising the recipient on apartment building reconstruction. If the bidder cannot submit the required evidence and the contracting authority cannot verify the absence of exclusion grounds from public registers, the bidder must provide the documents within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, but they must prove equivalent competence.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest 1 euro.
By submitting the bid, the bidder must confirm that it can provide, by the contract signing date at the latest, a first-demand guarantee letter issued by a credit institution, financial institution or insurance company in the amount of 5% of the construction contract value excluding VAT, or within 10 calendar days after signing the contract. The security may also be provided by depositing the corresponding amount into the contracting authority’s account or a notary account, provided that the beneficiary remains the recipient throughout the construction period.
As for previous experience, the bidder must prove that within the 60 months before the start of the procurement procedure it has carried out at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means the erection, extension or full reconstruction of a building as the main contractor, and it must have included at least the construction or reconstruction of the load-bearing structure and external envelope, the construction or reconstruction of a heat-recovery mechanical ventilation system, or the construction or reconstruction of a new heating system. The bidder must provide the project name, building details, period of performance, value, and an explanation of the project content.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person qualified to perform electrical works. The project manager must have at least level 6 professional qualification as a building engineer or a level 6 construction manager qualification with the relevant specialisation; the site manager must have at least level 5 construction foreman qualification; the ventilation and heating systems specialist must have at least level 6 qualification as a heating, ventilation and cooling engineer or a level 6 construction manager qualification with the relevant specialisation; the water supply and sewerage systems specialist must have at least level 6 qualification as a water supply and sewerage engineer or a level 6 construction manager qualification with the relevant specialisation; and the person performing electrical works must hold a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. If the bidder relies on the capacities of other persons, signed confirmations of their participation in contract performance must be attached.
