Compliance requirements
The machine-readable notice included exclusion grounds for criminal organisation participation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder or its management, administrative or supervisory body members, or persons authorised to represent or control the bidder must not have a final conviction for these offences within the last five years, unless the exclusion period has expired. If an exclusion ground exists, the bidder may be allowed to show self-cleaning measures where the procurement documents or applicable law permit it. The exact wording and any additional grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment or an equivalent register, and the contracting authority may require proof of registration. As a financial capacity requirement, the bidder’s net turnover for the last 3 completed financial years must have been at least EUR 5,000,000 per year. For technical capacity, the bidder must have completed within the last 60 months at least 2 contracts for construction of new buildings, each building with a net floor area of at least 3,000 m2, at least one contract for installation of underground cable lines of at least 500 m, and at least one contract for installation of underground water supply and sewer pipelines of at least 700 m. When submitting the bid, the bidder must confirm that the bid complies with the tender documents and, where necessary, that equivalence has been explained and evidence of equivalence has been attached. A document proving the existence of the bid guarantee is also required; the guarantee must be EUR 50,000 as a bank or insurer guarantee or deposited to the contracting authority’s account. For furniture, the bidder must confirm the use of wood from legal sources and provide evidence regarding REACH candidate substances upon handover of the furniture.
