Compliance requirements
The bidder must confirm the standard exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, money laundering, terrorism-related offences, child labour or human trafficking, and no tax, social security or environmental charge arrears where applicable. The bidder must also confirm that it is not subject to sanctions and that none of the other listed exclusion situations apply. If an exclusion ground exists, the bidder may be allowed to show self-cleaning measures where the procurement documents permit it.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. The ESPD and the tender documents do, however, require the bidder to confirm resale rights from the manufacturer or an authorised reseller in Estonia, to provide a document proving those rights, and to provide a power of attorney if the offer is signed by someone other than the legal representative. The offer price must be submitted in the required structure, and the offer must comply with all technical specification or terms of reference requirements. The bidder must also confirm that the offer remains valid for at least 90 days and that the offer is not conditional.
