Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking, and other listed criminal offences. If an exclusion ground applies, the bidder may have to provide details such as the conviction date, reason, convicted person, exclusion period and self-cleaning measures. The machine-readable notice did not include the full list of exclusion grounds; the exact requirements must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years must be at least EUR 3,000,000. If the bidder relies on the resources of another company, the bidder must also provide that company’s details and consent, and the contracting authority will check that company’s suitability as well. As regards works experience, the bidder must have properly performed at least 1 contract for the construction or repair of a road or square within the last 5 years, with a scope similar to the contract subject matter; similar means roughly 20,000 m2 of asphalt surfacing area. The work must have been accepted by the client. The bid must include the details of the properly performed contract, a short description of its content, the value, the date of conclusion, the work period and the contact details of the other contracting party. The bid must comply with the tender documents, include the required documents and forms, and the bidder must confirm compliance with equivalence requirements where the tender documents refer to standards or other technical solutions. If any precise qualification or compliance requirement was not included in the machine-readable notice, it must be checked in the tender documents.
