Compliance requirements

The tender documents include mandatory exclusion grounds based on final convictions, including participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder or its management, administrative or supervisory body members, authorised representatives, or persons controlling the bidder must not fall under these grounds. If an exclusion ground applies, the bidder may be allowed to show self-cleaning measures where the procurement rules permit it. Subcontractor-related sanctions checks also apply to first-tier subcontractors during contract performance.

Qualification criteria and exclusion grounds

The bidder must demonstrate technical and professional capability with at least one previous construction contract completed within the 60 months before the start of the procurement. The requirement is very substantial: as main contractor or as a subcontractor carrying out or organising all construction works, the bidder must have either fully constructed or fully reconstructed, under a land improvement system construction project, at least 250 km of ditches, 310 culverts with a diameter of at least 400 mm, and at least 45 km or 205,000 m2 of roads; or carried out land improvement system renewal or maintenance covering at least 1,300 km of ditch restoration, 1,600 culvert maintenance, and at least 45 km or 205,000 m2 of road construction or reconstruction. In the ESPD, the bidder must provide details of the relevant completed construction contracts, and on the contracting authority's request also a list of the most important contracts and a confirmation from each client that the work was performed properly. The bid must comply with the tender documents, conditional bids are not allowed, and any equivalence must be explained with supporting evidence. A bid guarantee must be provided by a credit or financial institution or an insurer, or by depositing the amount in the contracting authority's account, and it must remain valid at least until the end of the bid validity period.
