Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy or liquidation, tax or social security debt, and the other grounds specified in the tender documents. In a joint bid, each joint bidder is checked separately. The bidder must also confirm that its average wage during the reference period was above 70% of the average wage in the relevant field and, if requested, provide a Tax and Customs Board extract or an equivalent certificate from the country of establishment. The bidder must confirm that it is not a related party to the technical consultant advising the beneficiary on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered under the construction activity with the activity types for general construction, indoor climate systems, and indoor or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but an equivalent proof of competence must be provided.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover may not be aggregated; it is sufficient if at least one joint bidder meets the requirement on its own.
Within the last 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value excluding VAT. An equivalent project must include the erection, extension or full-building reconstruction of a building and at least the construction or reconstruction of load-bearing and external envelope structures, mechanical ventilation with heat recovery, and heating systems. The bidder must provide the project name, timing, value, project content, and proof by a handover-acceptance certificate, a use notice, a building permit, or an equivalent document.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person competent to carry out electrical works. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate. The project manager must have at least level 6 construction engineer or level 6 construction manager qualification with the relevant specialization; the site manager at least level 5 construction work supervisor qualification; the ventilation and heating systems specialist at least level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification with the relevant specialization; the water supply and sewerage systems specialist at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification with the relevant specialization; and the electrical works person at least a class B competence certificate or level 6 electrical engineer qualification for consumer electrical installations. For a foreign bidder, equivalent competence is sufficient.
The bidder must be ready to provide a performance-period guarantee amounting to 5% of the contract value at contract signature or within 10 calendar days after signature. The bidder must also submit the bid form, a power of attorney for a joint bid if applicable, a power of attorney for representation if applicable, a trade-secret notice, and documents proving equivalence where the bid relies on equivalent solutions.
If the machine-readable notice did not include precise requirements for any item, they must be checked in the official tender documents or tender documents. The bidder must also confirm that the bid complies with the procurement documents and that any equivalence is explained and supported by evidence, if used.
