Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act § 95(1)(1)–(5) apply to it. In practical terms, this means no relevant convictions for the bidder’s management or authorised representatives, no illegal employment-related offences, no child labour or human trafficking offences, no tax or social security debt as described, and no conflict with international sanctions. The machine-readable notice did not include any more specific exclusion requirements; they must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must be entered in the commercial register of its country of establishment if this is required by that country’s law; an Estonian bidder does not need to submit a register extract. To prove technical and professional ability, the bidder or its subcontractor must have completed within the last 60 months at least one contract for the design of refractory lining for a high-temperature industrial unit and at least one contract for installation and/or repair works of refractory lining. Both references are subject to specific minimum requirements: for design, the hot-face area on one unit must have been at least 200 m², the operating temperature at least 900 °C, the unit must have operated in an abrasive environment, and the designed solution must have been a multilayer refractory lining; for installation and/or repair works, the lining area on one unit must have been at least 150 m², the operating temperature at least 900 °C, the unit must have operated in an abrasive environment, and the works must have included installation or repair of a multilayer refractory lining. The experience must be comparable to CFB boiler cyclones or other equivalent units with similar thermal and erosion conditions. The bidder must submit the forms “List of engineering works” and “List of construction works” and confirm that all listed contracts were performed properly. For contract performance, the team must include a site manager with technical competence in refractory lining works and experience on similar projects, and a refractory lining specialist with a valid API 936 certificate or another listed equivalent proof. Both key persons must submit a CV, evidence of competence, and their consent to participate; a written consent for processing personal data is also required. The bidder must provide a technical solution description covering the full lining system, layers, insulation, anchoring system, installation method, work sequence and main stages. The materials list must be submitted on the contracting authority’s form and each material’s suitability must be supported by technical data sheets; qualitative indicators without numerical values and supporting documents are not accepted. The bid must comply with all tender document requirements, be unconditional, and the bid price must be submitted in the required structure.
