Compliance requirements
The machine-readable notice includes mandatory exclusion grounds for convictions such as participation in a criminal organisation, corruption, fraud, terrorist offences and related offences, and other standard exclusion checks from the tender passport. If an exclusion ground applies, the bidder may have to show self-cleaning measures, where allowed by law or the tender documents. The notice also requires confirmation that the bidder and certain related persons are not subject to the listed exclusion grounds. Precise details for all exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s average annual net turnover for each of the last three financial years ended by the start of the tender must be at least EUR 1,750,000. The turnover must be declared in the tender passport, and the successful bidder must provide supporting extracts on request if the data are not freely available from public registers. The tender must comply with the tender documents, remain valid for at least 4 months, and be submitted in the required structure. Where equivalence is relied on, the bidder must confirm that the necessary evidence has been attached. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The bidder must also provide the names and personal identification codes of authorised persons, or confirm that no such persons exist. If the bidder is successful, contract-signatory details and the contract performance contact person must be provided.
