The tender documents state the standard exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act: no final conviction for participation in a criminal group, breach of integrity duties, corruption, fraud, terrorist offences, money laundering or terrorist financing; no final conviction for enabling illegal work or breaching the rules on work by foreigners in Estonia, including paying below the statutory wage; no final conviction for illegal use of child labour or human trafficking; no tax, environmental charge or social security contribution arrears in the sense described in the notice; and no conflict with international sanctions. The tenderer must also confirm that these grounds do not apply and that it has reviewed the regulations and instructions on the contracting authority’s website.

The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if this is required by the law of that country. For bidders registered in Estonia, the contracting authority checks the data itself. A foreign bidder must submit a valid certificate of registration. The machine-readable notice did not include any other precise qualification, suitability or financial requirements; these must be checked in the tender documents.
