Compliance requirements
The bidder must not have tax debt, environmental charge debt, or social security contribution debt under the laws of its country of establishment. The machine-readable notice did not include any other precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have at least 1 properly performed contract within the 60 months before the publication deadline of the contract notice, under which it carried out harbour quay construction works or repair/reconstruction works. To prove this, the bidder must submit the contract details on the contracting authority’s Appendix 3 form, a confirmation from the client that the contract was properly performed, and a short description of the contract, the performance period, the other party’s contact details and, in the case of a public procurement, the reference number. If the bidder relies on the capacities of another undertaking, it must submit that undertaking’s consent and, where relevant, indicate the subcontractor and the reliance in the tender. In the case of a joint tender, Appendix 6 must also be submitted if the joint bidders rely on each other’s capacities. The person responsible for the repair works must hold at least Level 6 professional qualification of civil engineer with specialisation in port construction in the field of construction management or site management, or an equivalent qualification. If the responsible person’s qualification was obtained outside Estonia, copies of the supporting qualification documents must be submitted. The tender must be signed by the legal representative or an authorised person, and a power of attorney must be attached if needed. The bidder must also complete the contracting authority’s price table and confirm that the tender complies with the procurement documents and that any equivalence has been explained where necessary.
