Compliance requirements
The bidder must confirm the mandatory exclusion grounds listed in the tender passport, including criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and other legally required grounds. The notice also requires confirmation about self-cleaning measures where applicable. The machine-readable notice did not include the full precise list of exclusion grounds; these must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have technical and professional capacity proven by proper performance of at least one contract for construction works on a publicly used road within the 60 months before the start of the procurement. The contract value must be at least EUR 50,000 excluding VAT. As proof, the bidder must provide a list of relevant contracts and, upon request, a confirmation from the client covering the works, deadline and contract value. If the bidder relies on the resources of another company, the bidder must also provide that entity’s details and, where required, its consent to participate in performance of the contract. The bid must comply with the procurement documents, any equivalence must be explained where necessary, and the bid price must be submitted according to the prescribed cost schedule structure. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The machine-readable notice did not include all precise qualification details; these must be checked in the official tender documents or tender documents. The notice also requires the bid to confirm compliance with the tender documents and, where relevant, equivalent solutions and supporting evidence. If the bidder submits a joint bid, a power of attorney from the joint bidders is required.
