Compliance requirements
The notice includes standard exclusion grounds. A bidder must confirm that neither the company nor its management, administrative or supervisory body members, representatives or controlling persons have been finally convicted in the last five years for offences such as participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, or terrorist offences. The bidder must also confirm that it does not use a subcontractor that must be replaced under the relevant law. For some exclusion grounds, self-cleaning measures may be presented. Qualification criteria and exclusion grounds
The bidder must prove that, within the 60 months before the start of the procurement, it has completed at least one construction contract of the required scope and content. The requirement is met if the bidder, as main contractor or as a subcontractor carrying out or organising all construction works, has either: 1) fully built or fully reconstructed at least 15 km of ditches and at least 15 culverts with a diameter of at least 400 mm in the area of the regulating network of a land improvement system; or 2) fully carried out the renewal or maintenance of a land improvement system in the amount of at least 75 km of ditch restoration and at least 75 culvert maintenance works. The bidder must submit in the ESPD data on the completed contracts and, at the contracting authority’s request, a list of the major works and confirmations from the client or main contractor that the work was performed properly. If the bidder relies on the resources of another company, the bidder must also provide that company’s details and consent. According to the compliance conditions, the bidder must submit the price offer form, a power of attorney in the case of a joint bid, proof of the bid guarantee or a guarantee letter, and confirmation that the bid complies with the tender documents and that equivalence has been explained where necessary.
