Compliance requirements
The bidder must confirm the mandatory exclusion grounds listed in the tender documents, including final convictions for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder must also confirm that it does not use a subcontractor that would have to be replaced under the Public Procurement Act and that it does not use subcontractors or suppliers subject to the EU sanctions restrictions described in the tender documents. If an exclusion ground applies, the bidder may be allowed to demonstrate self-cleaning where the tender documents or law allow it.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capacity with at least one previous construction contract completed within the 60 months before the start of the procurement. The requirement can be met in two alternative ways: either by fully constructing or reconstructing at least 10 km of ditches and at least 10 culverts with a diameter of at least 400 mm in the regulated network area of a drainage system, or by fully carrying out drainage system renewal or maintenance covering at least 50 km of ditch restoration and at least 50 culverts with a diameter of at least 400 mm. The bidder must provide the contract data in the ESPD and, on the contracting authority's request, a list of the relevant completed contracts, a confirmation from the client or main contractor that the work was performed properly, and, where the bidder relies on another entity's resources, the other entity's details and consent. The bid must comply with the tender documents, conditional bids are not allowed, the bid guarantee must be provided in the required form and remain valid at least until the end of the bid validity period, and equivalence must be demonstrated where necessary. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also confirm compliance with RMK environmental requirements for forestry work in the forest environment conditions.
