Compliance requirements
The tender documents include mandatory exclusion grounds. A bidder must confirm that neither the bidder nor its management, governing or supervisory body members, nor persons authorised to represent or control the bidder, have been finally convicted in the last five years for offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or other listed exclusion grounds. If an exclusion ground applies, the bidder may need to show self-cleaning measures where allowed. The exact full list and any detailed conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last two completed financial years must be at least EUR 500,000. If the financial year follows the calendar year, this means 2025 and 2024. The bidder must provide the net turnover figures for those years in the ESPD.
A project manager must be involved in carrying out the construction works. The project manager must have at least one of the following qualifications, or an equivalent qualification: “Construction Engineer, level 6” in the sub-specialty “Building Construction” in the occupation area “Construction Management”, or “Construction Manager, level 6” with the full specialisation in general construction. The contracting authority does not consider a construction management occupation certificate equivalent, nor does it accept only an initial qualification issued solely on the basis of education.
If the specialist’s certificate was issued in Estonia, the contracting authority will verify it in the public qualification register and no separate document is needed. If the certificate was issued outside Estonia, the bidder must submit a document from the competent issuing body and a document from the competent Estonian authority confirming that the foreign qualification corresponds to the qualification required by the contracting authority. The bidder must provide the project manager’s details in Form 4.
When submitting the bid, the bidder must also complete Form 2, Form 3 and, where applicable, Form 8. The bid must accept all terms set out in the tender documents, and the price must be submitted in euros excluding VAT both in the eRHR worksheet and in Form 3. If a joint bid is submitted, an authorised representative must be appointed and a power of attorney and a joint and several liability confirmation must be provided. The bidder must also submit the business-secret marking and a separate list of the relevant documents.
