Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply to it, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that bankruptcy or liquidation proceedings have not been initiated against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. In addition, the bidder must confirm that it has no tax, fee, environmental charge, social security or similar debt under the law of its country of establishment. The bidder must confirm that its average salary during the reference period was more than 70% of the average salary for the same period in the relevant field, where the reference period is six calendar months ending with the calendar month before the month in which the procurement procedure was launched. The bidder must provide a Tax and Customs Board statement, or an equivalent certificate from a competent authority in its country of establishment, and in a joint bid the proof must be submitted for each joint bidder. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building.
Qualification criteria and exclusion grounds
The bidder must be registered in the Register of Economic Activities under the activity of construction, with activity types covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. These registration requirements do not apply to a foreign bidder, but the bidder must prove equivalent competence with an equivalent certificate.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest euro.
The bidder must confirm acceptance of the condition that by the contract date, or within 10 calendar days after contract signature, it must be able to provide a performance security equal to 5% of the contract value. The security may be a guarantee from a credit or financial institution, a deposit into the contracting authority’s bank account, or a deposit into a notary’s account, provided that the contracting authority remains the entitled beneficiary throughout the construction period.
Within the 60 months before the start of the procurement procedure, the bidder must have completed at least one equivalent construction work with a value of at least half of the estimated contract value excluding VAT. An equivalent work means the erection, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the building’s load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a new heating system. To prove completion, the bidder must provide the number of the occupancy notice or occupancy permit in the building register, or a copy of the handover-acceptance certificate signed by the client and contractor.
The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction, or level 6 construction manager qualification specialising in general construction; for a foreign bidder, an equivalent qualification is acceptable. The team must also include a site manager with at least level 5 construction foreman qualification specialising in general construction works. In addition, a ventilation and heating systems specialist, a water supply and sewerage systems specialist, and, for electrical works, a competent person are required. A level 7 authorised architect must be responsible for compliance with the European New Bauhaus requirements. For each required person, the bidder must provide the name and the number of the professional or competence certificate.
