Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory board members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing.
The bidder must also confirm that no other exclusion grounds set out in the tender documents and the ESPD apply. If an exclusion ground exists, the bidder may provide a description of self-cleaning measures and supporting evidence, where permitted.
The bidder must confirm that it will not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Estonian Public Procurement Act. The bidder must also confirm that the offered product or solution is not subject to international sanctions and does not originate from sanctioned regions.
Qualification criteria and exclusion grounds
The bidder must prove that, within the 36 months preceding the contract notice, it has completed at least one street lighting construction or repair contract worth at least EUR 50,000 excluding VAT. The work may have started earlier, but it must have been accepted within that 36-month period.
For the reference, the bidder must provide the contract subject, public procurement reference number, client details and contacts, the period of performance, and the value excluding VAT. On the contracting authority’s request, a confirmation letter from the client must be submitted to show that the contract was performed properly; if the client is Tartu City Government, the confirmation letter is not required.
The bid must comply with the requirements set out in the procurement documents and, where relevant, include an explanation and evidence of equivalence. In the case of a joint bid, an authorised representative must be named and a joint-bidder power of attorney must be attached. The bid price must be submitted in the required pricing table structure. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
