Compliance requirements
The tenderer must confirm that none of the mandatory exclusion grounds apply: no convictions of the company’s managers or representatives for organised crime, corruption, fraud, terrorist offences, money laundering or terrorism financing; no conviction for illegal employment of foreigners or breach of foreign workers’ conditions; no conviction for illegal use of child labour or human trafficking; no tax, environmental charge or social security debt; and no conflict with international sanctions. The tenderer must also confirm that none of the voluntary exclusion grounds apply, including serious or repeated breach of earlier public contracts or false statements or missing documents about qualification.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 500,000. An extract from the annual accounts for the last three completed financial years must be provided if the data are not publicly available to the contracting authority from a register.
Within the 60 months before the publication of the contract notice, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the tender, and at least one of them must have had a value of at least EUR 200,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in public procurement cases, the reference numbers. The contracting authority may also request evidence of proper performance. The bidder must submit completed form 3.
The bidder must have a person in charge of electrical works with a valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who has the relevant proof at the time of submission and has been added to the Elektrilevi partner portal before the opening of tenders. The bidder must also have a person designated as responsible for the work operation, who must be entered in the Elektrilevi partner portal before the opening of tenders.
If the bidder relies on another undertaking’s economic and financial standing, it must submit a digitally signed confirmation or proof from that undertaking stating that the necessary resources are available, that their use is permitted, and that they will be made available to the bidder for the entire contract period. The bidder and the supporting undertaking are jointly liable for the part of the contract performed on the basis of those resources.
The bidder must submit completed form 1 for the price offer table. If subcontracting is used, form 2 and the list of subcontractors must be submitted. For representation rights, the bidder must provide the names and contact details of the contract signatory and the contact person; if the authority to sign does not arise from the articles of association, a power of attorney must be included.
