Compliance requirements
The successful bidder must confirm that none of the exclusion grounds listed in § 95(1) points 1–3 and 5 of the Public Procurement Act apply to it or to a joint bidder, taking into account § 95(2). The bidder and any joint bidder must not be bankrupt or in liquidation, nor subject to bankruptcy or liquidation proceedings, nor have their business suspended, nor be in a similar situation under the law of their country of establishment. The bidder must have no tax debt, environmental charge debt, or social security contribution debt under the law of its country of establishment. The bidder must also confirm that it is not a related person to the technical consultant advising the grant recipient on the apartment building reconstruction. The machine-readable notice did not include more precise exclusion requirements; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and building-related water supply or sewerage systems. For electrical works, the bidder must have a business activity notice in the business register for electrical works and the activity type of construction of electrical installations, including installation; for a foreign bidder, an equivalent proof may be accepted. The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT; the exact amount must be entered to the nearest 1 euro. The bidder must be able to provide a performance security equal to 5% of the contract value by the contract date at the latest, or within 10 calendar days after contract signature, and the security must remain valid throughout the construction period. As equivalent construction experience, the bidder must prove at least one project completed within the last 60 months with a value of at least half of the estimated contract value, carried out as the main contractor for the erection, extension, or full reconstruction of a building; the project must have included at least construction or reconstruction of the load-bearing and external envelope structures, construction or reconstruction of a heat-recovery ventilation system, or construction or reconstruction of a new heating system. The bidder must provide the project name, timing, value, and proof such as a notice of use, occupancy permit, or handover-acceptance report. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works; for each person, the bidder must provide the name and the number of the professional or competence certificate. The project manager must have at least level 6 professional qualification as a civil engineer with a building construction specialization or level 6 qualification as a construction manager with a general construction specialization. The site manager must have at least level 5 qualification as a construction work supervisor with a general construction specialization. The ventilation and heating systems specialist must have at least level 6 qualification as a heating, ventilation and cooling engineer with the relevant management competences, or level 6 qualification as a construction manager with a specialization in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 qualification as a water supply and sewerage engineer with the relevant management competence, or level 6 qualification as a construction manager with a specialization in building-related or building-adjacent water supply and sewerage systems. The person involved in electrical works must have at least a category B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. For foreign qualifications, equivalent proof is accepted. The bidder must have a quality management system in the construction sector complying with EVS-EN ISO 9001 and an environmental management system complying with EVS-EN ISO 14001, or equivalent conditions are accepted. The machine-readable notice did not include more precise qualification requirements; they must be checked in the official tender documents.
