Compliance requirements

The machine-readable notice includes standard exclusion grounds from the ESPD, including criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking. The bidder must confirm whether any such ground applies to the company or to its management, administrative or supervisory body members, representatives or persons with decision-making or control powers. If an exclusion ground exists, the bidder may have to provide evidence of self-cleaning where allowed. The exact list and any detailed answers must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must demonstrate at least one previous main contractor contract completed within the 60 months before the start of the procurement, under which at least 20,000 m2 of road surface was surfaced on a public road. Only works accepted by the client during that period are counted. If a bid is submitted for several lots, one such contract is sufficient for lots 1, 2 or 3. The bid must include the contract description, client details, contact details, contract period and the surfaced road area. Under the compliance requirements, the bidder must confirm that it accepts all tender document terms, submits a bid only for the requested matters, does not submit a conditional bid, performs the work in accordance with the tender documents, and does not use a subcontractor that would have to be replaced under section 122(7) of the Public Procurement Act. In the case of a joint bid, an authorised representative must be named. If the bidder relies on the resources of another company, that company’s consent and the ESPD must be provided in the bid documents.
