Compliance requirements
The tender documents state the usual exclusion grounds: the bidder may be excluded if it or its management/representation bodies have been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; if it has been convicted for enabling work for an illegally staying foreign national; if it has been convicted for illegal use of child labour or human trafficking; or if it is subject to an international sanction. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract. The bidder must confirm the absence of exclusion grounds and, if applicable, provide evidence of no tax debt. The exact confirmations and evidence must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must hold a business activity notice for construction, specifically for public water supply or sewerage. A bidder registered outside Estonia must provide, on the contracting authority’s request, evidence of the required registrations or operating licences. As a whole, the bidder must have successfully completed, within the last 5 years, at least 2 km of public water supply or sewerage pipeline works and the installation of at least 3 compact wastewater pumping stations. To prove this, the bidder must submit a list of similar construction works carried out during the last 60 months on form KII. When submitting the bid, the bidder must also complete the forms PI and, if applicable, PII required in the tender documents. The machine-readable notice did not include any more precise compliance requirements; these must be checked in the tender documents.
