Compliance requirements
The bidder must confirm the absence of exclusion grounds. The notice states that the contracting authority will exclude a bidder if the bidder or its management, supervisory or representative persons have been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, illegal employment of foreigners, or child labour and human trafficking offences. The bidder may also be excluded for tax or social security debt, breach of sanctions, serious or repeated breach of previous public contracts, or false information. The bidder must submit the confirmations on the required form, and in a joint bid each joint bidder must provide the relevant confirmations.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU, EEA or WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. An Estonian bidder does not need to submit a copy of the registration certificate, but the contracting authority may request it from other bidders.
If the bidder relies on the capacities of another undertaking, it must provide details of that entity and also submit that entity’s confirmations on the required form.
The bidder’s net turnover for each of the last three completed financial years before the start of the tender procedure must have been at least EUR 200,000 excluding VAT per year. If the financial year is not the calendar year, the bidder must provide data for the relevant financial years. The bidder must submit the turnover information on the required form and, upon request, an extract from the annual accounts or other evidence.
Within the last 60 months, the bidder must have completed at least 2 building construction and/or reconstruction contracts. At least one of those contracts must have included facade and structural reconstruction works, and the enclosed net floor area of that building must have been at least 500 m2. The bidder must provide information on the completed contracts and, upon request, a confirmation from the client.
The bidder must also submit the participation application, the tender price submission, the legal capacity confirmation, proof of site visit, a power of attorney for joint bidders if the bid is joint, and an explanation and evidence of equivalence if equivalent solutions are used in the bid.
