Compliance requirements
The bidder must confirm the absence of the exclusion grounds listed in the tender documents. These include convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal employment of foreigners, illegal use of child labour or human trafficking, tax or social security debt, and situations where the contract would breach an international sanction or a sanction of the Government of the Republic of Estonia. If the bidder is a joint bidder, each joint bidder must submit the confirmations required on the prescribed form. The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU Member State, an EEA contracting state or a WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. If the bidder relies on the capacities of another entity to prove economic and financial standing or technical and professional ability, confirmations must be submitted both for the bidder and for the supporting entity. Net turnover for each of the last three completed financial years before the start of the procurement (2023, 2024 and 2025) must be at least EUR 150,000 excluding VAT per year. If the financial year is not 1 January to 31 December, the bidder must provide turnover data for its corresponding financial-year periods. The bidder must submit turnover information on form HD Annex 5 and, on request, an extract from the annual accounts or other proof. In addition, the bidder must submit the participation application on form HD Annex 2, the bid price in the required structure and on form HD Annex 7, and, where relevant, the joint bidders’ power of attorney on form HD Annex 4. The bid must comply with the tender documents, and if equivalence is relied on, it must be explained and supported by evidence.
