Compliance requirements
The notice includes mandatory and voluntary exclusion grounds. The bidder must confirm that none of the mandatory grounds under Section 95(1) of the Public Procurement Act apply, including convictions related to organised crime, corruption, fraud, terrorism, money laundering, illegal employment of foreigners, child labour or trafficking, tax or social security debt, and international sanctions. The bidder must also confirm that none of the voluntary exclusion grounds under Section 95(4) apply, such as breaches of labour, social or environmental obligations, bankruptcy or liquidation, serious professional misconduct, collusion, conflicts of interest, prior serious contract breaches, false information, attempts to influence the contracting authority, tax offences, or lack of the right to submit a tender or request. In addition, bidders with residence or registered office in the Russian Federation or the Republic of Belarus are not allowed to participate, and materials, equipment and goods used in the works, including components, must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 300,000. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years. At the time of tender submission, at least six months must have passed since the end of the last completed financial year. The bidder must provide an extract from the financial statements or other required evidence if the data are not publicly available to the contracting authority from a register. If the bidder relies on another undertaking’s economic and financial standing, it must submit a digitally signed confirmation or proof from that undertaking, and liability for the relevant part of contract performance is joint and several. As regards technical capacity, during the 60 months before the start of the procurement the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 80,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s contact details and, in public procurements, the reference numbers; the contracting authority may request proof of proper performance. For tender compliance, the price table must be submitted in the required format and all unit price fields must be completed. In addition, before tender opening the bidder must have a worker with valid switching authorisations entered in the EPP environment, a person responsible for the work operation, and a person managing electrical works with valid A-competence or at least level 6 qualification. The bidder must also provide the contract signatory’s details and the contact person’s details, and a power of attorney if needed. The machine-readable notice did not include any more precise requirements; these must be checked in the official tender documents.
