Compliance requirements
The machine-readable notice states that the successful bidder will be checked for exclusion grounds. The bidder must confirm that neither it nor a joint bidder has the exclusion grounds listed in § 95(1) points 1–3 and 5, taking into account § 95(2). The bidder must also confirm that neither it nor a joint bidder is bankrupt or being liquidated, is not subject to bankruptcy or liquidation proceedings, and has not suspended business or entered a similar situation under the law of its country of establishment. In addition, the bidder must confirm that it has no tax, fee, environmental charge, social security or similar debt under the law of its country of establishment. The bidder must also confirm that its average wage during the reference period was above 70% of the average wage for the same period in the relevant field, and this must be evidenced with a Tax and Customs Board extract. Finally, the bidder must confirm that it is not a related person to the technical consultant advising the contracting authority’s apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, but they must prove equivalent competence with an equivalent document.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated value of the contract, excluding VAT. The exact amount must be stated to the nearest euro.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means the construction, extension or full-building reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing structure and external envelope, the construction or reconstruction of a heat-recovery ventilation system, and the construction or reconstruction of a heating system. The bidder must provide the project name, building details, execution period, value, information on the nature of the works, and proof by means of a use notice, building permit number, or a copy of the handover-acceptance certificate.
The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction or level 6 construction manager qualification specialising in general construction. The team must also include a site manager, a ventilation and heating systems specialist, a water supply and sewerage systems specialist, and a person involved in electrical works. For each role, the bidder must provide the person’s first and last name and the qualification or competence certificate number. For foreign bidders, an equivalent qualification is acceptable.
The ventilation and heating systems specialist must have at least level 6 qualification as a heating, ventilation and cooling engineer with the relevant competencies, or level 6 construction manager qualification specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 qualification as a water supply and sewerage engineer, or level 6 construction manager qualification with the relevant specialisation. The person involved in electrical works must have at least a Class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations.
The bidder must have a quality management system in the field of construction works that complies with at least EVS-EN ISO 9001, and an environmental management system that complies with at least EVS-EN ISO 14001, or equivalent requirements.
