Compliance requirements

The machine-readable notice includes the standard exclusion grounds from the tender passport, including convictions for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, terrorist offences and related crimes. The bidder must confirm whether any of these grounds apply to the bidder, its management or supervisory bodies, or persons authorised to represent or control it. If an exclusion ground exists, the bidder may be allowed to submit evidence of self-cleaning, where permitted by law or the tender documents. The exact list and any detailed conditions must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder’s net turnover for the last completed financial year must be at least EUR 150,000. The bidder must provide the relevant data and, upon the contracting authority’s request, an extract from the latest annual report or other proof of turnover. For the performance of the works, the bidder must have a responsible specialist, i.e. a site manager, throughout the contract period. That person must hold at least the qualification of Site Manager, level 6, with specialisation in general construction, or Construction Engineer, level 6, with specialisation in building construction, or an equivalent professional qualification. The bidder must provide the person’s first and last name, qualification and certificate number, and upon request also a copy of the certificate and a consent to act as the responsible person in performance of the contract. If the bidder is not established in Estonia, it must submit an equivalent certificate issued in its country of establishment or evidence of the relevant professional qualification. The bid must comply with the procurement documents, and where equivalence is relied on, it must be explained and supporting evidence must be attached. In the case of a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be included.
