Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD, or that the exclusion period no longer applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm the sanctions-related requirements: it must not involve subcontractors or suppliers accounting for more than 10% of the contract value if they are citizens, residents or companies established in the Russian Federation, or persons or entities owned or controlled by them, or acting on their instructions. The bidder must also confirm that it does not use a subcontractor that would be subject to replacement under Section 122(7) of the Public Procurement Act. The offered goods must not be subject to international sanctions and must not originate from sanctioned territories.

Qualification criteria and exclusion grounds

The bidder’s average net turnover for the last three completed financial years must be at least EUR 290,000. If the bidder has operated for less than three years, the average is calculated for the years of operation. The bidder must have completed at least two design-and-build contracts in the last five years. The contracts must concern the design and construction of an automatically operated, remotely controlled pellet boiler house with an input capacity of at least 500 kW, or a technologically similar boiler house such as a wood-chip boiler house. Both works must have been completed, performed in accordance with the contract and accepted by the client. The bidder must name the person responsible for design and construction management. That person must hold at least level 7 professional qualification as a certified thermal energy engineer, or an equivalent certificate giving the right to act as the responsible specialist for managing the design and construction of boiler houses. The bid must include a list of completed works showing the object name and location, a short description of the works, contract value, period of performance, and the client’s name and contact details. The contracting authority may also request client references confirming proper performance. If the bidder relies on the resources of another company, a written consent from that company and confirmation of its direct involvement in contract performance must be provided.
