Compliance requirements
The bidder may be excluded if there is a mandatory exclusion ground under the Public Procurement Act. The contracting authority may also exclude a bidder if a previous public contract, utility-sector contract or concession contract was terminated early, or if damages, price reduction or comparable sanctions were imposed because of a serious or repeated breach of an essential contract term. The machine-readable notice did not include more detailed exclusion requirements; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years before the start of the public procurement must be at least EUR 100,000 per year. During the 60 months preceding the start of the procurement, the bidder must have completed at least two contracts for the construction or repair of a canal or a similar water conveyance structure, and under one of those contracts a total of at least 200 m2 of bank protection must have been built or repaired. For the completed contracts, the bidder must provide the contract and completion dates, a short description of the work performed, and the details of the other contracting party; in the case of a public procurement, the reference number must be shown. If the bidder relies on another company’s resources to meet the qualification requirements, the corresponding consent must be submitted. In the case of a joint bid, a power of attorney signed by the joint bidders must be attached. The bid must comply with the procurement documents and, where necessary, evidence explaining equivalence must be included. The bid price must be submitted in euros, excluding VAT, with accuracy to two decimal places, and it must cover all costs related to contract performance.
