Compliance requirements
The tenderer will be excluded if any of the statutory exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply: criminal convictions of the company or its management/representation bodies for corruption, fraud, terrorism-related offences, money laundering or financing terrorism; unlawful employment of foreigners or breach of foreign workers’ employment conditions, including paying less than the statutory wage; child labour or human trafficking offences; tax, social security or environmental charge arrears; or a conflict with international sanctions. The tenderer must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if required by that country’s law, and must provide evidence of registration if it is not an Estonian company. To prove technical capability, the bidder or its subcontractor must have performed at least one similar contract within the 60 months before the start of the procurement, relating to inspection and repair of industrial chimneys at a height of at least 50 metres. Form 2 must be submitted with the dates and contracting parties. The bidder and/or its subcontractor must also have at least two persons responsible for the works, each holding at least a rope access technician level 2 certificate or equivalent, completed rope access training, and a GWO/IRATA or equivalent certificate issued by an institution accredited in Estonia or the European Union. Form 3 and copies of the qualification documents must be submitted; a foreign bidder may submit equivalent documents from its country of establishment and a commitment to provide the confirmation issued by the Consumer Protection and Technical Regulatory Authority within one month after contract signature. The machine-readable notice did not include any more precise requirements; they must be checked in the official tender documents.
