Compliance requirements
The tender documents include standard exclusion grounds. The bidder must confirm that neither the company nor its management, administrative or supervisory body members, nor persons authorised to represent, decide for or control the company, have been finally convicted in the last five years for offences such as participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, terrorist offences, or other listed exclusion grounds. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The exact list and any detailed conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register since at least 2020. The person responsible for the construction works must hold at least a level 6 initial professional qualification as a construction engineer with a specialisation in general construction. The ESPD must include the responsible person's name, professional qualification and certificate number. If the qualification was issued in Estonia, the contracting authority will verify it in the register; for a foreign qualification, the bidder must provide the qualification document and confirmation from the competent Estonian authority that it meets the required qualification. If the bidder relies on another company’s resources, a written commitment from that company and an ESPD for that entity must also be submitted. The bid must comply with the tender documents, conditional bids are not allowed, the bid price must be submitted in the required structure, and before submitting the bid the bidder must have inspected the site and been registered with the contracting authority’s administrative manager. The machine-readable notice did not include precise qualification or compliance requirements; these must be checked in the tender documents. The exclusion grounds and the site-inspection requirement are also reflected in the tender documents.
