Compliance requirements
The tender documents include the standard exclusion grounds from the Public Procurement Act, especially convictions for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder or its management, legal representative or supervisory body members must not have a final conviction within the last five years, unless the exclusion period has expired. If an exclusion ground exists, the bidder may need to show self-cleaning measures. The exact list and any detailed confirmations must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capability through previous experience. At least one completed works contract within the 60 months before the start of the procurement is required, meeting one of two alternatives: either works under a land improvement system construction project, fully built or fully reconstructed, including at least 15 km of ditches and at least 10 culverts with a diameter of at least 400 mm; or land improvement system renewal or maintenance works, including at least 75 km of ditch restoration and at least 50 culvert maintenance works with a diameter of at least 400 mm. The bidder must provide the contract data in the ESPD and, if requested by the contracting authority, a list of the relevant contracts, a confirmation from the client or, if the bidder was not the main contractor, a confirmation from the main contractor that the work was performed properly. If the bidder relies on another entity’s resources, the data and consent of that entity must also be submitted. As compliance requirements, the bidder must submit the price quotation form, a joint bidders’ power of attorney if the bid is joint, proof of the EUR 500 bid guarantee, confirmation that the bid complies with the tender documents, any equivalent-solution explanations and evidence, and the marking of trade secrets if applicable. The bidder must also confirm compliance with RMK environmental requirements for forestry work and confirm that no prohibited subcontractor or Russia-related sanctioned subcontractor or supplier is used in performance of the contract.
