The bidder must not be subject to the exclusion grounds set out in Section 95(1) of the Public Procurement Act. The same check also applies to any entity whose resources the bidder relies on for qualification. The contracting authority may also exclude a bidder under Section 95(4)(8) if there has been a breach of previous public contracts. This check also extends, where relevant, to relied-on entities. The bidder must confirm that neither the bidder nor any relied-on entity has these exclusion grounds. If the answer is no, the bidder must describe which ground or breach applies. Entities established in Russia or Belarus are not allowed to participate in the procurement. The same prohibition applies to any entity whose qualification the bidder relies on.

The bidder’s net turnover for each of the last two completed financial years must have been at least EUR 100,000. If the bidder’s financial year follows the calendar year, the relevant years are 2025 and 2024. The bidder must have completed at least 1 similar construction project within the 60 months before the publication of the contract notice. A similar project means construction work for access control systems. The bidder must submit the data on signed and properly performed contracts in Form 1 and, if requested, a client confirmation letter showing that the works were carried out properly. The bidder must also submit Form 4 for the specialists. The construction project manager must have at least the professional certificate “Civil Engineer, level 6” with the specialisation “Building construction” and the selected competence “Management of construction activities”, or at least the certificate “Construction Manager, level 6” with the specialisation “General construction” without restriction on selected competences. The responsible specialist for security systems must have level 5 professional qualification with the specialisation “Installation and maintenance of alarm systems” or an equivalent qualification. Basic qualifications based only on education are not accepted as equivalent. If any professional certificate or other qualification document was issued outside Estonia, it must be submitted with the bid. In a joint bid, Form 8 with the power of attorney and the confirmation of joint and several liability must be submitted. Form 2 and Form 3 must also be submitted, and the bid must comply with all tender document requirements. If the bidder relies on another entity’s experience or qualification, that entity must meet the relevant requirements and perform the relevant part personally.
