Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, and terrorist offences. The bidder must also confirm that the persons representing the company or controlling it are not subject to these exclusion grounds. If an exclusion ground exists, the bidder may have to provide evidence of self-cleaning where allowed by the procurement documents or law.
Qualification criteria and exclusion grounds
The bidder must demonstrate financial and technical capacity and submit the required confirmations and documents.
- The bidder’s total net turnover for the last three financial years must be at least EUR 3,000,000. The contracting authority may request annual report extracts or other evidence of turnover.
- The bidder must have at least one properly performed contract within the last 60 months for the construction or reconstruction of a publicly used road or street, including the installation of at least 4,500 m2 of the top layer of asphalt concrete surfacing.
- The bidder must also have at least one contract within the last 60 months under which at least one gravity pipeline of at least 20 m in length and with an internal diameter of at least De160 mm was built under an asphalt-surfaced publicly used road or street.
- In addition, the bidder must have at least one properly performed contract within the last 60 months for the construction of a bridge, viaduct, tunnel, ecoduct, or a shoreline protection structure or other hydraulic structure on a water body; the exact scope of this condition was not clear from the input, so it must be checked in the tender documents.
- If the bidder relies on the capacities of another entity, that entity’s consent and confirmation must be submitted, stating that it will participate in the performance of the contract in the part relied upon and that it has no relevant exclusion grounds.
- In the case of a joint tender, a power of attorney from the joint bidders must be submitted.
- The bidder must submit a confirmation that it accepts all terms of the contract notice and tender documents, will involve persons meeting the contract requirements in performance of the contract, and will take into account the contracting authority’s green procurement aspects when procuring and installing outdoor furniture.
- A bid security of EUR 5,000 must be provided with the tender.
- The bidder must provide information on the persons representing the company if they are not visible in the business register.
- If the tender contains trade secrets, they must be identified and justified; the tender price and other numerical indicators related to award criteria may not be marked as trade secrets.
- The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions.
