Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, terrorist offences, and related criminal offences. The bidder must also confirm the required statements about self-cleaning measures where applicable. The machine-readable notice did not include the full precise exclusion text for all grounds, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start date of the procurement must be at least EUR 75,000. Joint bidders may aggregate turnover. To prove compliance, the contracting authority may request an extract from the latest annual report or other evidence; for a legal entity registered in Estonia, this may not be required if the data are publicly available to the contracting authority. If the bidder relies on the resources of another company, the bidder must also provide that company’s details and, if requested, its consent stating that it allows reliance on its turnover, will provide financial resources for contract performance if needed, and will be jointly and severally liable for the part of the contract performed using its resources. For technical and professional capacity, the bidder must submit a list of road construction contracts matching the authority’s specified characteristics and completed within the last 60 months, and, upon request, a confirmation from the client that the works were performed properly. The tender must comply with the tender documents, including submission of a fully completed HD IV bill of quantities as an Excel file. In the case of a joint bid, a separate ESPD must be submitted for each joint bidder.
