Compliance requirements

The bidder must confirm the mandatory exclusion grounds related to criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking, terrorist offences, and the required sanctions-related declarations. The notice also requires confirmation of the bidder’s authorised persons who are not visible from the business register extract, or confirmation that such persons do not exist. If an exclusion ground applies, the bidder may need to show self-cleaning measures where allowed. Qualification criteria and exclusion grounds

The bidder must demonstrate economic and technical capacity. The net turnover for the last financial year ended by the start of the procurement must be at least EUR 75,000. Joint bidders may combine their turnover figures. To prove turnover, the contracting authority may request an annual report extract or other evidence; for a legal entity registered in Estonia, this may not be required if the data are publicly available. For technical capacity, the bidder must provide a list of road construction contracts for publicly used roads that meet the contracting authority’s specified characteristics and were completed within the 60 months before the start of the procurement, together with evidence that the works were carried out properly. The contracting authority may also take older contracts into account if needed to ensure sufficient competition. To demonstrate compliance, the bidder must submit the fully completed HD IV bill of quantities as an Excel file. In the case of a joint tender, a power of attorney for the joint representative and separate ESPD documents for each joint bidder are required. If the bidder relies on the resources of another company, the bidder must also provide that company’s details and, where necessary, its consent and evidence of its turnover.
