Compliance requirements
The machine-readable notice includes mandatory exclusion grounds such as participation in a criminal organisation, corruption, fraud and other serious offences. If an exclusion ground applies, the bidder may be allowed to show self-cleaning measures, but the exact conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment. The contracting authority may require proof of registration. For technical and professional capacity, at least 2 previous contracts for the sale of goods or provision of services that match the contracting authority’s specified characteristics and were performed within the 36 months before the start of the procurement are required; a public contracting authority may also take older contracts into account. For those contracts, the bidder must provide a description, total amount, currency, the bidder’s area of responsibility, contract amount, period, and the client’s and contact person’s details. Under the compliance requirements, the bidder must confirm that the bid complies with the procurement documents, that a joint bid includes the joint bidders’ power of attorney, that the bid price is submitted in the required structure, and that any equivalence is explained and supported by evidence. For office IT equipment, the bidder must confirm at least a 2-year warranty or a longer required warranty period, declare REACH candidate-list substances above 0.1% by mass, and, for the reuse and recycling service, describe the service arrangement and provide evidence of membership in a producer responsibility organisation, a cooperation partner, or an environmental permit for waste management.
