Compliance requirements
The tenderer must not be subject to the exclusion grounds listed in the Public Procurement Act, including convictions for organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or breach of wage rules; child labour or human trafficking; tax or social security debt; or sanctions that would prevent the contract from being signed. The contracting authority may also exclude a tenderer for serious or repeated breach of a previous public contract, or if the tenderer has submitted false information or failed to provide required documents. The tenderer must confirm the absence of exclusion grounds in the required form.
Qualification criteria and exclusion grounds
The bidder must have completed road construction contracts during the last 60 months that included at least 16,000 m2 of road surface dressing in total. The work must have been carried out under a signed contract and in accordance with good practice, and the bidder must provide the contract details. If the bidder relies on another company’s resources, that company must be registered as a subcontractor and its signed confirmation of the absence of exclusion grounds and confirmation that it will participate in the performance of the contract in the part relied on must be submitted. The bidder must have competence for road construction; this is presumed if the bidder has a road construction activity notice registered in the business register. If a subcontractor is relied on, the subcontractor’s details and consent must also be provided. The tender must be submitted on the price quotation form, and the price must be final and include all costs of performing the contract. In a joint tender, an authorised representative must be appointed and the joint tenderers’ power of attorney must be attached.
