Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption and fraud. The notice also refers to other standard exclusion grounds in the ESPD, but the machine-readable text does not provide the full list in the excerpt. If an exclusion ground applies, the bidder may be allowed to demonstrate self-cleaning measures where the procurement rules permit it. Qualification criteria and exclusion grounds
The bidder’s total turnover for the last three completed financial years must be at least EUR 50,000 excluding VAT. To prove this, the contracting authority may request extracts from annual accounts or other documents; for a legal entity registered in Estonia, this may not be required if the data are publicly available from the register.
For technical and professional capacity, the bidder must have performed at least 2 sales contracts for similar footwear or an equivalent product during the last 36 months. The bidder must provide the contract description, dates, value and, where needed, confirmations from the client or contracting party that the contracts were properly performed. If the bidder relies on the resources of another undertaking, the bidder must also submit an ESPD for that entity and its consent to the reliance.
The bid must comply with the procurement documents. The bidder must submit material information in the form of manufacturer data or other documents that allow the contracting authority to assess compliance with the technical specification. The material documents must not simply be copied from the technical specification; an original document copy and an Estonian translation are required if the document is not in Estonian. The documents must not be older than 3 years.
Product samples must be submitted by the tender submission deadline in accordance with the technical specification. If the samples do not comply, the bid may be deemed non-compliant.
If this is a joint bid, a power of attorney for the joint bidders must be attached. The bid must not be conditional. The bidder must also confirm that the bid complies with the procurement documents, that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that subcontractors or suppliers linked to Russia are not used for more than 10% of the contract value.
