Compliance requirements
The tenderer must confirm that neither the tenderer nor any entity whose resources the tenderer relies on has the exclusion grounds set out in Section 95(1) of the Public Procurement Act. The tenderer must also confirm that neither the tenderer nor any such entity has the exclusion ground under Section 95(4)(8) relating to breach of previous public contracts. If the answer is no, the tenderer must describe the relevant exclusion grounds or contract breaches. The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must have been at least EUR 140,000. If the financial year matches the calendar year, the last three completed financial years are 2025, 2024 and 2023.
The bidder must have carried out at least one similar construction work within the 60 months before the publication date of the contract notice. The contract value of the similar work must have been at least EUR 50,000 excluding VAT. A similar work means repair work on a heritage-protected object that included at least facade plastering or facade reconstruction. The experience must be evidenced by contract details for duly concluded and properly performed contracts; the contracting authority may also request a confirmation letter from the client.
A project manager must be involved in carrying out the construction works. The project manager must have either a level 6 construction engineer qualification, with the subfield of building construction and the occupational area of construction management, or a level 6 construction manager qualification with the specialisation general construction, including facade works. A qualification in construction management as an occupational area is not considered equivalent, and neither are basic qualifications issued solely by educational institutions. For an Estonian qualification certificate, the contracting authority checks the qualification in the public professional register; for a foreign certificate, the bidder must submit the relevant proof and a document from the competent Estonian authority confirming equivalence.
Together with the bid, the bidder must submit Form 1 with the data needed to verify qualification and Form 4 for the project manager. If the qualification certificate or other proof was issued outside Estonia, the corresponding documents must also be submitted. In the case of a joint bid, Form 8 must be submitted together with the power of attorney and the confirmation of joint and several liability for the joint bidders.
The machine-readable notice did not include any more precise compliance requirements; these must be checked in the tender documents or official tender details. The bidder must also submit Form 2 and Form 3 as required by the tender documents, and the bid price must be entered both in the electronic worksheet and in Form 3. If the Form 3 total differs, Form 3 prevails. The bid must be prepared so that trade secrets can be separated and listed with justification if applicable. The bidder must confirm that it is not based in Russia or Belarus, and that any entity whose qualification it relies on is also not based there.
