Compliance requirements
The tender documents include mandatory exclusion grounds. A bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor persons authorised to represent, decide for, or control the bidder, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking, and that any exclusion period stated in the conviction has expired. If an exclusion ground exists, the bidder may have to show self-cleaning measures, and the notice indicates that electronic evidence may be available. The exact wording and any additional exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
As regards technical and professional capacity, the bidder must have a lawyer in the team for handling debt claims, with at least a bachelor’s degree or an equivalent legal qualification, or the bidder must be able to cooperate with such a person when performing the concession contract. That person must have previous work experience in debt collection. The bidder must provide the person’s details in the ESPD. In addition, the bid must include a concept for organising the collection service, describing how claim information is transmitted, how and how often the current status of claims is reported back, and the process for dealing with debtors whose place of residence or establishment is outside Estonia. The bidder must also confirm that it has an electronic database for managing debtors and their debts and that it can report on claims under collection, closed claims, and claims paid partly or in full at least twice a month on Mondays. In a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. Conditional bids are not allowed, and the bidder must confirm that the bid complies with the procurement documents.
