Compliance requirements
The bidder must confirm the standard exclusion grounds, including no final convictions in the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, and other mandatory grounds listed in the tender documents. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The machine-readable notice did not include the full list in a concise form, so the official tender documents must be checked for the exact wording and any additional grounds.
Qualification criteria and exclusion grounds
The bidder’s average net turnover in the road construction sector for the last three financial years ending before the start of the procurement, i.e. 2023, 2024 and 2025, must be at least EUR 300,000 per year. If the bidder has operated for less than three years, the average turnover over the operating period must also be at least EUR 300,000. Joint bidders may combine their turnover figures. The bidder must provide the turnover data for those years in the ESPD. For the execution of the works, the bidder or joint bidders, and any subcontractor directly involved in performance where applicable, must involve a site manager with at least Road Engineer qualification level 6 or an equivalent certificate in the country of establishment. The name of the qualified person, the qualification and the certificate number must be provided. If the certificate was issued in Estonia, the contracting authority will verify it in the public qualification register. If it was issued abroad, a copy of the certificate and a document from the competent Estonian authority proving equivalence must be submitted. The bid must comply with the tender documents and conditional bids are not allowed. In a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be included. If subcontracting is used, the subcontracted parts and the subcontractor confirmation must be provided. Where equivalence is claimed, supporting evidence must be attached.
