Compliance requirements
The machine-readable notice includes exclusion grounds for criminal organisation participation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder must confirm whether any of these grounds apply to the company, its management or supervisory body members, or persons authorised to represent or control it. If an exclusion ground applies, the bidder may also need to show self-cleaning measures, if allowed by the tender documents or applicable law. The notice also requires confirmation that the bidder does not use a subcontractor that would have to be replaced under the relevant law.
Qualification criteria and exclusion grounds
The bidder must provide in the ESPD the total annual turnover for each of the last three completed financial years before the start of the procurement. In each of those financial years, the turnover must be at least EUR 200,000.
For technical and professional capacity, the bidder must have properly performed at least 1 similar construction contract for a facility, or participated as a significant subcontractor in the performance of such a contract, within the 72 months preceding the start of the procurement. Similar works are stadium or sports field construction works, including works involving artificial surfacing, and may consist of either new construction or reconstruction of an existing facility. If the bidder relied on a subcontract, it must describe its specific share of the works. The bidder must provide a short description of the contract, the performance period, and the client and/or main contractor details; for public procurement contracts, also the reference number. Upon request, the contracting authority may require evidence of proper performance.
For bid compliance, the bidder must confirm that the bid complies with the requirements set out in the procurement documents, that conditional bids are not allowed, and that equivalence has been explained and supporting evidence attached where necessary. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The bidder must also submit the price schedule in the required structure.
