Compliance requirements
The tender documents list the standard exclusion grounds: participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and other mandatory exclusion grounds under Estonian public procurement law. If any exclusion ground applies, the bidder may need to provide evidence of self-cleaning, if allowed by the procurement documents or the law. The machine-readable notice did not include a complete, item-by-item exclusion summary, so the official tender documents must be checked for the exact wording and any additional grounds.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register or the equivalent register in its country of establishment. The bidder must also have a trade notice in the economic activities register for the activity area “Construction”, activity type “general construction work”.
Financial requirement: the bidder’s average annual turnover for the period 01/01/2023–31/12/2025 must be at least EUR 100,000.
Technical and professional requirement: to perform the contract, the bidder must have a site manager responsible for the construction works, namely a construction engineer at least level 6 (excluding initial qualification) or equivalent. The bidder must provide the specialist’s name and other required information, and the successful bidder must submit copies of the professional certificate or equivalent proof if requested.
Compliance requirements: the bid must comply with the tender documents, and conditional bids are not allowed. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must confirm that the bid meets all requirements in the procurement documents and that it does not use a subcontractor who would have to be replaced under Section 122(7) of the Public Procurement Act. The bidder must also confirm that the offered goods are not the object of international sanctions and do not originate from sanctioned regions.
