Compliance requirements

The bidder will be excluded if the exclusion ground referred to in Section 95(1) and Section 95(4)(8) of the Public Procurement Act applies. The machine-readable notice did not include precise exclusion grounds; these must be checked in the tender documents. The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members are subject to recent convictions for corruption, terrorist offences, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, and that no current exclusion period applies. If any such ground exists, the bidder must state it and, where relevant, provide the conviction date, reason, person convicted, exclusion period and any self-cleaning measures. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.

Qualification criteria and exclusion grounds

The bidder must have technical and professional capacity, demonstrated by at least one responsible person for managing water and sewer pipeline construction works and one responsible person for managing district cooling and district heating pipeline reconstruction and construction works. For both roles, the bidder must provide the person’s name, personal identification code or date of birth, and professional qualification. On the contracting authority’s request, qualification documents must be submitted even if the person works as a subcontractor. The person responsible for water and sewer pipeline works must have at least the qualification of a certified water supply and sewerage engineer, or an equivalent qualification, EQF/Estonian qualification framework level at least 7, with specialisation in external water supply and sewerage and competence in managing construction activities. The person responsible for district cooling and district heating pipeline works must have at least the qualification of a certified authorised thermal energy engineer, with specialisation in district heating and district cooling systems, competence in managing construction activities, or an equivalent EQF/Estonian qualification framework level at least 7. The bidder must also prove prior experience: during the 60 months before the start of the procurement, it must have properly completed at least 100 m of drinking water pipeline construction with an internal diameter of at least de200 using the open-trench method, at least 100 m of concrete gravity sewer or stormwater sewer construction with an internal diameter of at least DN/ID 1000 using the open-trench method, and the construction of at least one concrete chamber (tank) measuring at least 2.0 x 2.0 x 2.0 m. These works may have been completed under up to two contracts. The bidder must submit the contract dates, a short description of the works and the other party’s details; the contracting authority may request proof of performance. The bid must be submitted in the structure required by the procurement documents, including the price forms for Raua and Raua põik and for Kreutzwaldi. Conditional bids are not allowed, and the bidder must confirm that the bid complies with all tender document requirements and that any equivalence has been explained and supporting evidence attached. In the case of a joint bid, a power of attorney for the authorised representative must be included. The bidder must also confirm that no subcontractor who would be subject to replacement under Section 122(7) of the Public Procurement Act will be used in contract performance.
