Compliance requirements
The tender documents include mandatory exclusion grounds. The bidder must confirm that neither the bidder nor its management, supervisory or representative persons have been finally convicted in the last five years for criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, terrorist offences, or other listed grounds. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The exact list and any detailed confirmations must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 20,000. Joint bidders may combine turnover figures. To prove this, the contracting authority may request an extract from the latest annual report or other evidence; separate proof may not be needed if the data are publicly available in the Estonian business register. For technical and professional capacity, the bidder must provide a list of road construction contracts for publicly used roads completed within the 60 months before the start of the procurement, and the contracting authority may request a client confirmation that the works were performed properly. The exact experience requirement and any additional evidence must be checked in the tender documents. The bid must also meet the compliance requirements: the bidder must confirm acceptance of all terms in the contract notice and procurement documents, submit a bid only for the matters requested by the contracting authority, not involve a subcontractor that would have to be replaced, and submit the fully completed HD IV bill of quantities as an Excel file. In the case of a joint bid, a power of attorney for the authorised representative and separate ESPDs for all joint bidders must be submitted.
